The death penalty is explicitly prohibited for any offence committed by a person under the age of 18, but life imprisonment remains a lawful sentence for offences committed by children and males under the age of 18 may be sentenced to corporal punishment.

QATAR: Inhuman Sentencing of Children

Life imprisonment is a lawful penalty in Qatar for offences committed by children aged 16 or older. The death penalty and corporal punishment are prohibited under criminal legislation, but appear to remain lawful under Sharia law for offences committed while under the age of 18.

UNITED STATES: Inhuman sentencing of children

Capital punishment is unconstitutional for offences committed by persons under the age of 18 and sentences of corporal punishment are unavailable for all offences. However; life imprisonment is lawful across the country and life imprisonment without the possibility of release remains lawful for homicide offences in the majority of states and under the federal criminal justice system.

INDIA: Inhuman sentencing of children

Since the enactment of the Juvenile Justice (Care and Protection of Children) Act 2013 in Jammu and Kashmir, life imprisonment has been abolished as a sentence for children in Jammu and Kashmir, but life imprisonment was reintroduced in the rest of India in December 2015. Corporal punishment may be lawful across India under traditional justice mechanisms, including Pipon.

BANGLADESH: Inhuman sentencing of children

The Children’s Act 2013 has substantially amended much of the relevant legislation on the criminal sentencing of children, explicitly prohibiting the death penalty and life imprisonment for children. However, children may still be sentenced to corporal punishment. People have also been sentenced to life imprisonment for offences committed while under the age of 18 since the Children Act came into force as a result of the application of legislation that was in force at the time of the alleged offence.

SWAZILAND: Inhuman sentencing of children

When the Children's Protection and Welfare Act came into force
in July 2013, it implemented wide reaching reforms of the juvenile justice system, abolishing corporal punishment as a sentence for children and reinforcing the prohibition on the death penalty for offences committed while under the age of 18. However, detention during His Majesty’s pleasure appears to remain a lawful sentence for child offenders.

IRAN: Inhuman sentencing of children

The Islamic Penal Code 2013 came into force in May 2013. The new legislation amends the law with regards to the death penalty, life imprisonment and corporal punishment, but these forms of sentencing remain lawful for offences committed by children.

PAKISTAN: Inhuman Sentencing of Children

People may be lawfully sentenced to corporal punishment, life imprisonment and the death penalty for offences committed while under the age of 18. Law reform has gone some way to eliminating corporal punishment, but since Pakistan lifted its unofficial moratorium in relation to terrorism cases in December 2014 and all capital cases in March 2015, it has returned to carrying out the death penalty for child offenders.

This report was initially prepared for CRIN in September 2010, but was updated in March 2017.
